For solicitors and agencies
You stay the adviser. We hold the file.
The employer with the direct contract carries out the right-to-work check. A hirer in a standard agency arrangement is not expected to repeat it. A business that only buys a service for its own use is outside the new chain liability. Your clients still need the copy, the name of who checked, the date, and — for sponsors — whether pay is still at the CoS figure. The official check stays on GOV.UK. Vernx does not run it and does not file SMS. Read the GOV.UK employer's guide (1 October 2026).
Agencies
If your agency is the employer with the direct contract, you carry out the check and keep that file. A hirer is not expected to repeat a standard supply check.
