Right to work · 1 October 2026
Who holds the right-to-work file after 1 October 2026?
The official check stays on GOV.UK. The employer with the direct contract carries it out. In a standard agency supply, that is the employment business, and the hirer is not expected to repeat the check. Extended liability does not apply solely because a business buys a service for its own use. It can apply where a business supplies work onwards, runs an online matching service, or the contract allows substitution.

What an inspector or a client will ask for
- A copy of the check (passport scan or share-code result).
- The name of the person who checked.
- The date of the check.
- For a sponsored worker, whether pay is still at or above the Certificate of Sponsorship figure.
What Vernx does not do
We do not run the Home Office check. We do not file a report on the Sponsor Management System. We do not create a statutory excuse. We keep the file after the check you already did.
This page is not legal advice. Read current GOV.UK guidance before you check.
