Supplier right-to-work statement checklist

This is a checklist of topics in the 1 October 2026 Code of practice on preventing illegal working, and of two pages in the GOV.UK Employer's guide. It is not contract wording, not legal advice, and not a statutory excuse. Vernx does not run the official check.

Read the documents themselves:

What to look for

  1. Who the papers say carries out the right to work check. Annex C, page 77, is the longstanding position that the employment business does the check. It is not written as a requirement for the hirer to repeat that check as a routine.
  2. Whether the supply arrangement has contractual right-to-work terms. The code, pages 24–26, treats those terms as one part of what a hirer in a labour supply chain should have.
  3. Whether someone has also carried out assurance or an audit of those arrangements. On those same pages, a contract promise on its own is not enough.
  4. Where a substitute is supplied, whether you can see that the substitute's check was done before they work. The code discusses substitutes on page 25.
  5. Whether you have read the Employer's guide FAQ at page 82 on where the duty sits, rather than relying on a supplier's statement alone.
